Terms and Conditions
These Terms and Conditions govern the payment and moving & delivery services provided by Metro Vans Limited to our customers. By engaging our services, you agree to these Terms.
1. Estimates and Quotations:
- Estimates: Initial estimates are provided based on the information you provide. These are subject to change based on actual volume, packing requirements, access conditions, and any unforeseen circumstances.
- Quotations: Written quotations are valid for 14 days from the date of issue unless otherwise stated. Any changes to the scope of the move may result in a revised quotation.
2. Payment Schedule:
- A deposit of 30% of the estimated/quoted amount is due upon booking confirmation.
- The remaining balance is due upon the completion of move or delivery.
- For long distance moves, a portion or all of the payment may be due prior to the Van or Truck leaving the pick up address.
- Any additional charges incurred during the move (e.g., extra packing materials, waiting time, storage fees) are payable immediately upon completion of the move or delivery.
3. Payment Methods:
We accept payments via visa cards, bank transfers and cash.
4. Late Payment:
- Late payments may incur a late fee of 7.5% per day on the outstanding balance.
- Failure to pay the outstanding balance within 7 days of the due date may result in legal actions being taken towards the account or referral to a collection agency.
- The customer will be liable for any additional recovery costs incurred towards the outstanding balance.
- The company reserves the right to hold goods until all monies owed to Metro Vans Limited are paid in full.
5. Additional Charges:
Additional charges may apply for:
- Extra packing materials, waiting time due to delays caused by the customer, difficult access (e.g., stairs, elevators, long carry).
- Disassembly and reassembly.
- Special handling of fragile or oversized items.
- Tolls and parking fees.
- Changes to the original inventory list.
You will be notified of any additional charges before they are incurred, whenever possible.
If extra services are requested on moving/delivery day, these must be paid for before the Van is unloaded.
6. Cancellation and Rescheduling:
- Cancellations made 5 days prior to the scheduled move date will result in a full refund of the deposit.
- Cancellations made less than 5 days prior to the scheduled move date may result in forfeiture of the deposit.
- Rescheduling requests must be made at least 7 days prior to the scheduled move date and are subject to availability.
- Rescheduling requests made less than 7 days prior to the scheduled move may incur a fee.
7. Claims & Disputes:
- Any disputes regarding payment must be submitted in writing to [email protected] within 24 hours of the invoice date.
- Any disputes regarding claims must be submitted in writing to [email protected] within 24 hours of the completion of the move or delivery.
- We will make every effort to resolve claims and disputes amicably.
8. Customer Responsibilities:
- The Customer must provide accurate information about the Goods, access, and delivery locations.
- The Customer must ensure that all Goods are properly packed and labeled.
- The Customer is responsible for disconnecting and reconnecting appliances.
- The Customer must be present during loading and unloading, or designate an authorized representative.
- The customer is responsible for ensuring that all fragile items are properly packed and labelled.
- The customer must notify the company of any exceptionally heavy or large items.
- The customer is responsible for obtaining parking permits.
9. Company Responsibilities:
- The Company will perform the moving & delivery services with reasonable care and skill.
- The Company will endeavor to complete the move/delivery within the agreed timeframe, but cannot guarantee specific arrival times.
- The company will provide a suitable vehicle for the move/delivery.
10. Delays:
The Company is not liable for delays caused by circumstances beyond its control, including but not limited to traffic, weather, road closures, or customer delays.
11. General Provisions:
- These Terms and Conditions constitute the entire agreement between the Company and the Customer.
- Any modifications to these Terms and Conditions must be in writing and signed by both parties.
- If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- The Company reserves the right to subcontract any part of the move/delivery.
12. Hazardous Materials:
The company will not transport any hazardous materials.
13. Liability and Limitations:
- Owner's Risk: Unless a "Declared Value" option has been purchased, all goods are moved at the owner's risk. The company will not be liable for loss or damage, except in cases of proven negligence.
- Declared Value Option: The customer may declare a value of their goods, and pay an extra fee in order to have the company's liability extended to that declared value.
- The Company is not liable for damage or loss caused by:
- Inadequate packing by the Customer.
- Pre-existing damage to the Goods.
- Electrical or mechanical malfunction.
- Circumstances beyond the Company's control.
- Perishable items.
- Jewellery, cash, or other high value items, unless specifically declared.
- Any claims for damage or loss must be reported in writing within 24 hours of delivery.
- The company will not be liable for damage caused to driveways or paths unless proven negligence.
14. Insurance:
- Metro Vans Limited operates as a licensed moving service provider.
- The company can arrange transit insurance at an additional cost to the customer upon request.
- The customer is strongly advised to obtain their own comprehensive insurance to cover any potential losses during transit.
15. Governing Law:
These Terms shall be governed by and construed in accordance with the laws of New Zealand.
16. Entire Agreement:
These Terms constitute the entire agreement between you and Metro Vans Limited regarding all payment and moving & delivery services. Please read carefully and understand these Terms before proceeding.
